Legal expert Melusi Xulu stated that Dr Nandipha Magudumana’s bid to have the Bloemfontein High Court declare her arrest in Tanzania as unlawful will not be successful.

 

According to the SABC news report, Mrs Magudumana launched a court bid to declare her arrest and deportation from Tanzania as “unlawful and wrongful”, this decision left many South Africans surprised and many believe that Mrs Magudumana was ill-advised by her lawyers.

A legal expert Melusi Xulu has given reasons why this bid will not succeed, the first factor was that Mrs Magudumana was in Tanzania illegally and the laws there allow for illegal immigrants to be deported, the second factor was that Mrs Magudumana had a pending warrant of arrest against her in South Africa.

The outcome of this bid will be determined when Mrs Magudumana makes an appearance in court on 20 June 2023.
