Dr Nandipha Magudumana and her co-accused can breathe a sigh of relief after the National Prosecuting Authority in the Free State province confirmed that they will be dropping the murder charge against them. This decision comes after new information was uncovered during investigations, which has resulted in the prosecution provisionally withdrawing the charge.
The accused were facing numerous charges, including aiding and abetting a prisoner to escape from jail and defeating the ends of justice. However, the dropping of the murder charge means that the bail application for Dr Nandipha Magudumana and her co-accused will move from a schedule six offense application to a schedule one. This means that the onus will now be on the state to show the court why they should remain behind bars.
While some have welcomed this news, many South Africans have expressed their disappointment and skepticism regarding the development. They argue that the case, which the National Prosecuting Authority said was water-tight, has now been weakened, and they are concerned that the accused could receive lenient sentences.
The case has been widely publicized, as it involves a highly publicized prison escape in which a prisoner was aided in escaping by Dr Nandipha and her co-accused. The prisoner, Bonginkosi Khanyile, was serving a sentence for murder and was considered dangerous.
The escape was eventually foiled, and the body of a young man named Katlego Bereng was found in Khanyile’s cell. Bereng’s family has laid charges against the state and G4S, a security company at the Mangaung Correctional Centre, and a memorial service for him was held on the same day as Dr Nandipha’s court appearance.
It remains to be seen how the case will develop, but for now, Dr Nandipha and her co-accused can at least look forward to the possibility of being released on bail.
